JR Kyushu Rail Pass Online Booking Terms and User Agreement (Enacted on March 1, 2019)

Kyushu Railway Company (hereinafter referred to as “JR Kyushu”) stipulates the JR Kyushu Rail Pass Online Booking Terms and User Agreement (hereinafter referred to as the “Terms and User Agreement”) as shown below for the use of JR Kyushu Rail Pass Online Booking, which JR Kyushu operates for foreigners visiting Japan.

Article 1(Scope of Application)

  • 1. The Terms and User Agreement shall apply to customers (hereinafter referred to as the “User”) who use the service (hereinafter referred to as the “Online Booking service”) provided by JR Kyushu through JR Kyushu Rail Pass Online Booking.
  • 2. With regard to the use of the Online Booking service, the User shall comply with the Terms and User Agreement in good faith.

Article 2(Date and Time)

  • Unless otherwise specified, the dates and times shown in the Terms and User Agreement shall be based on Japan Standard Time.

Article 3(JR Kyushu Rail Pass Online Booking service)

  • 1. The Online Booking service shall be a service which allows the User to apply for reservation, purchase, change, and refund tickets (hereinafter referred to as the “JR tickets”) stipulated in Article 7 via the PC.
  • 2. The language used in the Online Booking service shall be English, Korean, and Chinese(Simplified/Traditional).

Article 4(Eligibility for Use)

  • 1. The Online Booking service shall be available only for those who hold a passport issued by a country other than Japan and have the resident status stipulated in Article 2 (ii) of Immigration Control and Refugee Recognition Act (Cabinet Order No. 319 of 1951) and enter Japan (including those who have already entered Japan) as a temporary visitor (90 days) shown in Appended Table 1-(3).Non-Japanese citizens who are visiting Japan for the purpose of sightseeing and traveling on a short-stay visa.
  • 2. The User shall be able to reserve and purchase JR tickets for themselves and their travelling companions. The provisions stipulated in the preceding paragraph shall also apply to travelling companions.

Article 5(Change and Notification of Terms and User Agreement)

  • JR Kyushu may change the Terms and User Agreement without a prior notice to the User. The said change shall be deemed to be notified to the User by posting it on the website of JR Kyushu and shall come into effect when access to its notification on the web site becomes available to the User. After a change becomes effective, only the terms and conditions after the change shall be valid.

Article 6(Applicable Provisions)

  • The validity of JR tickets that the User purchases through the Online Booking service, excluding the items stipulated in the Terms and User Agreement, shall be based on the Regulations on Passenger Operations (terms of transport) and other general provisions stipulated on the Internet.

Article 7(Applicable JR Tickets for Reservation)

  • 1. The JR tickets that can be reserved through the Online Booking service shall be those stipulated in the following items:
    • (1) Special ticket “JR-KYUSHU RAIL PASS” (hereinafter referred to as the “Pass”).
    • (2) Special ticket “KRP option ticket” (hereinafter referred to as the “KRP option ticket”), which is valid only when it is used together with the Pass or the like.
  • 2. See the web site of JR Kyushu for the applicable Pass types and applicable trains for the KRP option ticket.
  • 3. The User can make a reservation for up to 7 people including adults and children and cannot make a reservation for 8 or more people. The User cannot make a reservation for children only.

Article 8(Reservation and Payment Methods)

  • 1. A reservation through the Online Booking service shall be made by the method specified by JR Kyushu on its web site.
  • 2. The User may reserve the KRP option ticket only if they have purchased the Pass through the Online Booking service or have a designated voucher (hereinafter referred to as the “Voucher”) purchased from the travel agencies designated by JR Kyushu and before they receive the Pass in accordance with the provisions of Article 13. To reserve the KRP option ticket, the User needs the Kyushu Rail Pass reservation number (hereinafter referred to as the “KRP Reservation No.”) issued by JR Kyushu upon reservation/purchase of the Pass through the Online Booking service or the number printed on the Voucher (hereinafter the KRP Reservation No. and the number printed on the Voucher are collectively referred to as the “KRP Reservation No., etc.”).
  • 3. The payment of the fare and fee of the JR tickets reserved through the Online Booking service shall be settled on the Internet by the credit card registered by the User upon making a reservation (the User must be the owner of the credit card) after the reservation by the User is finished. The acceptable credit cards and payment conditions shall be stipulated by JR Kyushu, and the User shall follow the regulations stipulated by a relevant credit card company for the use of a credit card.

Article 9(Reservation Period)

  • The reservation period on the Online Booking service shall be as prescribed in the following items.
    • (1) Start of reservation period
      • a) Pass
        10:00 of the day one month prior to the date you want to start using the Pass.
      • b) KRP option ticket
        10:00 of the day one month prior to the date of the train you want to ride.
    • (2) End of reservation period
      • a) Pass
        The day you start using the Pass.
      • b) KRP option ticket
        The day you ride the train.

Article 10(Reservation Time)

  • 1. The reservation time of the Online Booking service shall be 24 hours in the period stipulated in the preceding article.
  • 2. Notwithstanding the preceding paragraph, a reservation to be made on the date you start using the Pass or the date of the train you ride shall be as prescribed in the following items:
    • (1) Pass
      By 23:00.
    • (2) KRP option ticket
      6 minutes prior to the departure time of your train listed in the train timetable (hereinafter referred to as the “Departure Time”). For the trains which depart before 5:36, the acceptance of a reservation is ended at 23:00 of the previous day, and for the trains which depart after 23:06, the acceptance of a reservation is ended at 23:00 of the day.
  • 3. Notwithstanding the preceding paragraphs, the system may be irregularly stopped for maintenance, etc. In this case, a notification is made on the web site of JR Kyushu.

Article 11(Reply to Reservation)

  • 1. JR Kyushu shall show a reservation result page and send email to the mail address registered (hereinafter referred to as the “registered mail address”) by the User in response to a reservation made by the User (including the case where the reservation does not go through because of full occupancy or incorrect input in the reservation form, etc.). However, reservations made from 23:00 to 5:30 of the following day shall be processed on the system after 5:30 and then responded.
  • 2. When a reservation of the JR ticket goes through, the payment shall be settled by the credit card registered by the User upon reservation, and JR Kyushu shall send the User the Reservation No., etc. after confirming the settlement.
  • 3. The User may make inquiries through Inquiries provided on the web site of the Online Booking service if he/she does not receive a result from JR Kyushu after the designated result notification time passes. JR Kyushu shall send a result to the registered mail address of the User, and the User shall follow the instructions of JR Kyushu.

Article 12(Completion of Contract)

  • 1. A contract of transport between the User and JR Kyushu shall be completed either when completion of the settlement is confirmed in the reservation result page or when JR Kyushu sends a settlement completion notification to the registered mail address of the User.
  • 2. A JR ticket with which a transport contract between the User and JR Kyushu is completed shall be kept by JR Kyushu until the User receives or refund it.
  • 3. A JR ticket to be kept by JR Kyushu in accordance with the preceding paragraph shall be subject to the terms of transport stipulated by JR Kyushu, unless otherwise stipulated in the Terms and User Agreement.
  • 4. When the User gets on the train for which he/she has made a reservation through the Online Booking service, he/she shall go to the counter stipulated by paragraph 1 of Article 13 by 30 minutes prior to the Departure Time of the train for which he/she has made a reservation or which he/she wants to get on using the Pass or the like, and be sure to receive the JR ticket before getting on the train. If the User does not receive the JR ticket, he/she may not get on the train as in the contract of transport stipulated in paragraph 1.

Article 13(How to Pick-Up)

  • 1. The user shall pick up a JR ticket, which is kept by JR Kyushu as stipulated in paragraph 2 of the preceding article, at the station specified by JR Kyushu (hereinafter referred to as the pick-up site).
  • 2. The User shall present or submit the items stipulated in the following items. A JR ticket of which payment has been made by a credit card can be picked up by the card holder only.
    • (1) Credit card used for the payment of the JR ticket
    • (2) Print out of documents describing the contents of the reservation which was sent from JR Kyushu by e-mail to the registered mail address of the User, or KRP Reservation No., etc.
    • (3) Passport of the User
    • (4) Passports of companions if the User has also reserved and purchased the Pass for them
      (Note) When picking-up the Pass, each companion needs to present his/her own passport by himself/herself.
  • 3. JR Kyushu may not issue a JR ticket when it determines that the User does not satisfy the use condition of the reserved and purchased JR ticket as a result of check of the items present or submitted by the User or his/her companion(s) as stipulated in the preceding paragraph. In this case, the JR ticket which becomes invalid shall be refunded as stipulated in Article 14.
  • 4. The User shall receive the KRP option ticket together with the Pass which is issued or handed over in exchange for the KRP Reservation No., etc. used for the reservation.
  • 5. The User may pick up a JR ticket during the office hours of the relevant pick-up site from 4:30 to 23:30. Check the office hours of each pick-up site on the JR Kyushu web site.
  • 6. If the User fails to pick up a JR ticket, which is kept by JR Kyushu as stipulated in paragraph 2 of the preceding article, by the start date of the Pass or the date of boarding specified upon reservation of the said JR ticket, he/she cannot pick up the said JR ticket the following day and after. In this case, if the User shall contact JR Kyushu through Inquiries on the Online Booking service to indicate the JR ticket(s) which the User has not received and is (are) still valid at the time when JR Kyushu receives Inquiries, refund shall be made after deducting the refund handling charge stipulated in the terms of transport, etc. from the sales price of the said ticket(s) by the method specified by JR Kyushu.

Article 14(Change and Refund)

  • 1. Change and refund of a JR ticket which is reserved and purchased on the Online Booking service shall be based on the terms of transport, Terms and User Agreement, provisions on each special ticket, and other general provisions stipulated by JR Kyushu.
  • 2. Change and refund of a JR ticket before it is picked up shall be accepted on the web site from 5:30 to 23:00. Change of the train on the web site shall be made up to 6 minutes prior to the Departure Time of the train for the change. Acceptance of change and refund on the web site shall be ended at 23:00 of the previous day for trains which depart before 5:36, and at 23:00 of the day for trains which depart after 23:06. If the Departure Time of the train specified upon reservation passes, change and refund cannot be accepted.
  • 3. When a change or refund is requested before a JR ticket is picked up, payment of the JR ticket after change or the refund handling charge shall be made by a credit card, and then a refund shall be made for the JR ticket before change or the one for the refund.
  • 4. The number of permissible changes and refund handling charge for changes and refund made on the web site may be different from those stipulated in the terms of transport. The change and refund methods in this case shall be notified on the web site.
  • 5. Refund for reservation after a ticket is picked up shall be accepted at the pick-up site. For refund, the credit card that the User used for the payment upon reservation will be required.

Article 15(Handling upon System Failure)

  • 1. When the User cannot pick up a reserved JR ticket due to a system failure, etc. of the Online Booking service, JR Kyushu may ask the User to purchase a JR ticket by making payment for the fare and fee. In this case, JR Kyushu shall refund the JR ticket which the User cannot pick up by the refund method separately specified by JR Kyushu without collecting the refund handling charge.
  • 2. If a new reservation cannot be accepted due to a system failure, etc. of the Online Booking service, JR Kyushu shall ask the User to purchase a JR ticket at the pick-up site or stations of JR Kyushu other than the pick-up sites, using a means other than the Online Booking service. However, the JR tickets stipulated in item 2 of paragraph 1 of Article 7 cannot be purchased by any means other than the Online Booking service.

Article 16(Rejection of Use of Credit Card)

  • If the credit card registered and specified by the User cannot be used for reasons stipulated by a credit card company, the said credit card cannot be used for payment on the Online Booking service.

Article 17(Use of User’s Information)

  • 1. JR Kyushu shall use the information of the User obtained through his/her use of the Online Booking service (record of purchase, record of communication with server, and additional information required for the Online Booking service) to present the products and services of the Online Booking service, JR Kyushu and JR Kyushu Group Companies.
  • 2. JR Kyushu may share the information of the User stipulated in the preceding paragraph to the travel agency, etc. who issued the Voucher and the User shall give consent to it.
  • 3. JR Kyushu shall carefully handle the data of its members, which is personal information so that it will not leak outside and be used illegally. Handling of personal information shall comply with the provisions stipulated in “Handling of Personal Information” and “Privacy Policy” disclosed on the web site of JR Kyushu.

Article 18(Obligation of User)

  • The User shall comply with the following items when using the Online Booking service.
    • (1) The User shall comply with the laws and not offend public order and standards of decency when using the Online Booking service.
    • (2) The User shall not conduct any acts that may bring inconvenience or disadvantage relating to the Online Booking service to JR Kyushu or third parties, that may cause trouble to the Online Booking service, and that may violate laws and the Terms and User Agreement, etc., and other similar acts.
    • (3) The User shall not resell or exchange, directly or indirectly, part or all of a JR ticket purchased through the Online Booking service for money for profit purpose (including the agency action stipulated in the Travel Agency Act).
    • (4) The User shall not purchase JR tickets which exceed the quantity and frequency deemed as relevant using the Online Booking service.
    • (5) The User shall comply with the provisions stipulated in the Terms and User Agreement and not conduct any acts that JR Kyushu considers inappropriate.

Article 19(Indemnity of JR Kyushu)

  • 1. JR Kyushu shall not have any responsibility for the following items regarding the Online Booking service.
    • (1) Disadvantages incurred by the User or third parties due to incorrect information registered upon reservation (including incorrect entry and omission of entry, etc.);
    • (2) Disadvantages incurred by the members or third parties due to violation of the compliance items stipulated in the Terms and User Agreement and the items of the preceding article;
    • (3) Disadvantages incurred by the User or third parties due to modifications of the Terms and User Agreement;
    • (4) Disadvantages incurred by the User or third parties due to suspension, change, or termination of the Online Booking service (including the system) or limit of the User’s access to the Online Booking service by JR Kyushu;
    • (5) Disadvantages incurred by the User or third parties when there is any problem in the equipment used by the User, such as the model, configuration including the browser and version, and communication status, etc.;
    • (6) Disadvantages incurred by the User or third parties when the communication path was wiretapped and the KRP Reservation No., etc. and other transaction information are leaked despite due measures for safety taken by JR Kyushu;
    • (7) Disadvantages incurred by the User or third parties when the mail reception capacity of the User’s PC, etc. is exceeded due to a virus which is not disinfected and is attached to email sent by JR Kyushu or email sent by JR Kyushu of which size was considered generally relevant despite due measures for safety taken by JR Kyushu;
    • (8) Disadvantages incurred by the User or third parties due to the Online Booking service despite due attention paid by JR Kyushu.
  • 2. When the User violates the Terms and User Agreement and causes losses to JR Kyushu, JR Kyushu may file a claim for all the losses against the said User, and the said User shall compensate the losses.
  • 3. When JR Kyushu sends a reply or notification, etc. to the registered mail address via email, even if delivery of the email is delayed or the email is not delivered because the mail address is incorrect or a mail server failure occurs, etc., JR Kyushu considers that the said email is delivered as it should be.

Article 20(Preferential Terms)

  • The printed materials regarding the latest Online Booking service or the latest Terms and User Agreement and announcement posted on the web site shall supersede the previous Terms and User Agreement and announcements.

Article 21(Exceptional Handling)

  • JR Kyushu may perform handling different from those stipulated in the Terms and User Agreement when it is considered necessary.

Article 22(Stop and Suspension of Service)

  • 1. JR Kyushu shall limit the use of the Online Booking service at its discretion when it is considered necessary for the operation of the Online Booking service.
  • 2. JR Kyushu may stop and suspend the Online Booking service in any of the following cases:
    • (1) When emergency or periodical maintenance of the Online Booking service system is conducted;
    • (2) When the service cannot be provided properly due to an emergency situation such as war, riots, turbulence, labor dispute, earthquake, eruption, flood, tidal wave, fire, and electric failure;
    • (3) When JR Kyushu determines that temporary suspension is necessary in terms of the operation of the Online Booking service.
  • 3. When the operation of the Online Booking service is stopped or suspended as stipulated in the preceding paragraph, JR Kyushu shall notify the User of the stoppage or suspension by posting it to the web site of JR Kyushu in advance; provided, however, that this shall not apply to emergency cases.

Article 23(Management of KRP Reservation No., etc. and Password)

  • 1. The User shall use the KRP Reservation No., etc. and password to use the Online Booking service. JR Kyushu shall regard the person who inputs the KRP Reservation No., etc. and password as the User by confirming that the entered KRP Reservation No., etc. and password are matched with the registered ones. The User shall request for a password in the designated screen prepared by JR Kyushu, and JR Kyushu shall send a temporary password to the registered mail address. A validity period is set to the temporary password, and the User needs to set a permanent password by himself/herself.
  • 2. The User shall have responsibility for management of the registered KRP Reservation No., etc. and password after the registration procedure is finished. There is no case where the staff of JR Kyushu will ask the User the password.
  • 3. When the KRP Reservation No., etc. and password seem to be leaked or disclosed to a third party, or used inappropriately, the User shall fully understand the possibility that a third party may pretend to be the User and use the KRP Reservation No., etc. and password, carefully manage and keep the KRP Reservation No., etc. and password on his/her own responsibility, and endeavor to use them appropriately.
  • 4. When the User finds that the KRP Reservation No., etc. and password are stolen or used by a third party, he/she shall immediately notify JR Kyushu of it and follow the instructions given by JR Kyushu, if any. Losses caused by the use of the KRP Reservation No., etc. and password by a third party, regardless of before and after it is reported to JR Kyushu, shall be compensated by the User, and JR Kyushu shall not have any responsibility.
  • 5. When the User forgets the password or the validity period of a temporary password is expired, he/she shall request again for issuance of a temporary password stipulated in paragraph 1.

Article 24(Responsibility of User)

  • 1. The User shall have responsibility for the actions conducted by himself/herself for the use of the Online Booking service, and actions conducted by using his/her KRP Reservation No., etc. and their results, regardless of whether actions are conducted by himself/herself and whether there is an oversight.
  • 2. When the User causes losses to a third party in relation to the use of the Online Booking service, the User shall settle disputes with the said third party on his/her own responsibility and expense.
  • 3. When the User violates the Terms and User Agreement and causes losses to JR Kyushu, JR Kyushu may file a claim for the losses incurred against the said User.

Article 25(Governing Law and Jurisdiction)

  • 1. Any and all disputes arising between the User and JR Kyushu shall be settled in good faith between the parties.
  • 2. The Terms and User Agreement shall be governed by the laws of Japan,and it regard Japanese as official text. Furthermore all disputes between the User and JR Kyushu shall be submitted to the exclusive jurisdiction of the Fukuoka District Court or the Fukuoka Summary Court in the first instance.

Article 26(Effective Date of Terms and User Agreement)

  • The Terms and User Agreement shall come into effect at 5:30 a.m. on March 1, 2019 in Japan Standard Time.
